Recent reforms have introduced stricter eligibility rules for firearm ownership in NSW, with a strong
focus on citizenship and residency status. If you hold a licence, it’s important to check your status and
act promptly to remain compliant.
Non-Citizens
The legislation does not automatically cancel licences held by non-citizens or temporary visa
holders. However, it adds citizenship and residency as criteria for issuing or renewing a licence
under section 11.
Limited exemptions may apply, including certain New Zealand citizens with permanent
residency, provided their genuine reason falls within approved categories (e.g., primary
production, pest control, business employment, animal welfare).
What to do now: Monitor official updates and community notices, and arrange lawful transfer,
surrender, or storage of firearms through an approved dealer if permitted.
Permanent Residents (PRs)
PRs remain eligible for licences but must meet the same “genuine reason,” residency, and fitand-proper person requirements as citizens.
Proof of residency and ongoing compliance with safety and storage obligations is required.
Identity Verification
All new applications and licence renewals must include identity verification using a
Commonwealth service or a Commissioner-approved process. The legislation does not yet
specify which documents or services must be used; these details will be provided in the
regulations once released.
Required documents and consents must be submitted within the timeframe set by the
Commissioner; failure to do so may result in the withdrawal of the application.
Important: These changes represent a major shift in firearms regulation in NSW. Members are
encouraged to stay informed, maintain current club membership, and seek advice early to ensure
continued lawful ownership and participation.
